On July 1, 2013, the Plumbing Code of Australia was adopted by NSW. In this code, one of the necessary regulations was to ensure a temperature control device in every type of hot water system. This is important to ensure that the hot water temperature of the water coming from the tap doesn’t reach higher than 50 degrees centigrade.
This means that if your hot water system doesn’t have a temperature control device, your plumber should install it whenever you call in for repair. So, on your next repair, your plumber must install the device to follow guidelines. This would help in making sure that your tap doesn’t dispense water with a temperature of more than 50 degrees centigrade.
Generally, the cost of this installation is approximately $200. This is in addition to the installation costs of the hot water system.
If the plumber fails to install a temperature control device, then this is clearly against the law. It is non-compliance.
In this case, you can make a liability claim, where the tenant may have been exposed to burns from hot water due to the absence of a temperature control unit. This tenant can be a child or elderly or any other person.
